Gun Safety Legislation Introduced in the Michigan Legislature

Safe Storage Package

  • House Bill 5066Senate Bill 550: Require firearms to be properly secured to prevent accidental injury/death when the firearms could be accessible to minors. The bills create criminal penalties for failing to secure a firearm that is obtained by a minor and possessed in public or used in a reckless manner or to inflict injury or death. Introduced on 6/17/21.
  • House Bill 5068 / Senate Bill 552: Exempt firearm safety devices (including locks and safes) from the use tax. Introduced on 6/17/21.
  • House Bill 5069 / Senate Bill 553: Companion bills that amend the sentencing guidelines to include the new felony penalty created by HB 5066/SB 550. Introduced on 6/17/21.

Extreme Risk Protection Orders

  • Senate Bills 856857, and 858: Prohibitions on individuals with extreme risk protection orders from possessing or purchasing firearms. Introduced on 2/8/22.

Universal Background Checks

Magazine Capacity Limits

  • House Bills 5627 and 5628 / Senate Bills 785 and 786Would prohibit selling or possessing a magazine capable of holding more than 10 rounds of ammunition, beginning on January 1, 2023. A person who possessed such a magazine before the effective date could keep the magazine if they report possession of the magazine to the local law enforcement agency. Law enforcement officers, members of the armed forces, and individuals working in an armored car would be exempted. A person who violates this prohibition would be guilty of a misdemeanor, punishable by not more than 90 days in jail and/or a maximum fine of $500. A subsequent offense would be a felony, punishable by not more than 2 years in prison and/or a maximum fine of $5,000. Introduced on 12/9/21.

Protecting Victims of Domestic Violence

  • House Bills 5371 and 5372 / Senate Bills 678 and 679: Prohibit abusers convicted of misdemeanor domestic violence offenses from possessing guns for 8 years. This would bring MI into alignment with federal law. Introduced on 10/6/21.

Restoring Local Control

  • Senate Bill 352Allow local governments to ban guns on property owned or leased by local governments. Introduced on 4/13/21.

These bills would allow a person with a concealed pistol license to carry in a pistol free zone, including a school, school property, church, hospital, dormitory, and college classrooms.
